§1 Scope
These terms apply to all contracts for translation, certification and interpreting services between createtranslate, Fürstenrieder Str. 233, 81377 München, and its customers, whether consumers or businesses, unless otherwise agreed in a specific case.
§2 Formation of contract
Descriptions of services on this website are not a binding offer. For fixed-price documents, the contract is formed by your order in the checkout process and our order confirmation. For individually priced work, the contract is formed by our written quote and your acceptance of it.
§3 Scope of services
We provide translation across three quality tiers (Smart, Professional, Certified), certified translations by translators sworn at a German regional court, and interpreting services. Exact scope follows from the relevant product description, quote, or order confirmation.
§4 Customer obligations
You provide the document to be translated in legible form and tell us of any special requirement in good time. Delays or extra work caused by incomplete, illegible, or late-supplied material are not our responsibility.
§5 Prices and payment
All prices shown are gross, including statutory German VAT (19%), unless stated otherwise. We accept payment by bank transfer (invoice, prepayment). Other payment methods are shown where genuinely available at the time of order.
§6 Delivery and deadlines
Turnaround times are estimates unless expressly agreed as a binding deadline, and depend on the turnaround option chosen (Standard/Express/Same-day). Digital delivery is by email; stamped hard copies are sent via the shipping method you select.
§7 Rights in the translation
On full payment, you receive the usage rights in the translation necessary for the agreed purpose.
§8 Complaints and remedy
Complaints about a translation must be reported promptly, and no later than 14 days after delivery, identifying the specific passages concerned. Where a complaint is justified, we remedy it by correction within a reasonable period.
§9 Liability
We are liable without limitation for intent and gross negligence and under the Product Liability Act. For slightly negligent breach of a material contractual obligation, liability is limited to foreseeable, typical damage. Liability for slight negligence is otherwise excluded to the extent legally permitted. We accept no liability for a public authority's or court's decision on whether to accept a certified translation, as this lies outside our control.
§10 Confidentiality
We treat all documents entrusted to us confidentially and in line with our Privacy Policy. A separate non-disclosure agreement is available on request before any document is sent.
§11 Governing law and venue
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. Munich is the agreed venue for contracts with businesses. For consumers, the mandatory consumer-protection provisions of their habitual place of residence remain unaffected.
§12 Final provisions
Should any provision of these terms be invalid, the validity of the remaining provisions is unaffected.
